This document is a courtesy translation. The Portuguese version is the original and prevails in the event of any divergence — the contract, the tax record and the applicable law are all Brazilian.

1. Purpose and acceptance

These Terms govern access to and use of the website vitamunhoztecnologia.com.br, operated by Vita Munhoz Tecnologia, Brazilian tax number 59.414.271/0001-36, with offices at Rua Clorivaldo Migliari, 150 - Nova Ourinhos, Ourinhos - SP, 19907-475, Brazil.

By browsing the site you declare that you have read, understood and agree to these Terms and to our Privacy Policy. If you disagree with any point, please do not use the site.

This site is a corporate and contact channel. It presents our services and lets you talk to us — it is not, in itself, a contracting platform, and it does not carry out sales or online payments. Contracting and using the Vita Core Platform and the company services are governed by a separate document: the Terms of Service.

2. Services presented

The information about services, technologies, timelines and results published here is informative and non-binding. It does not constitute a commercial proposal or a guarantee of results.

Any engagement depends on a specific proposal and its own contract, with scope, deadlines, prices and terms negotiated case by case. Where the site and the signed contract diverge, the contract prevails.

The product pages describe the company's in-house products. They state the stage of each one; sign-up happens on each product's official website.

3. Permitted use

By using the site, you agree not to:

  • carry out acts that compromise the security, integrity or availability of the site, including intrusion attempts, code injection, reverse engineering or unauthorized scanning;
  • use bots, scrapers or automation that overload the infrastructure or circumvent rate limits;
  • submit, through the contact form, unlawful, offensive, defamatory or spam content, or content that infringes the rights of others;
  • reproduce, distribute or commercially exploit the site's content without authorization (see section 4);
  • use the site for any unlawful purpose or one contrary to these Terms.

We may suspend or block access for anyone who breaches these rules, without prejudice to any applicable legal measures.

4. Intellectual property

All content on this site — text, layout, visual identity, logos, trademarks, icons, images, animation, source code and the organization of the information — belongs to Vita Munhoz Tecnologia or to third parties who have licensed its use to us, and is protected by Brazilian copyright law (Law 9,610/1998), industrial property law (Law 9,279/1996) and software law (Law 9,609/1998).

The Vita Munhoz Tecnologia brand (and the "VM Tecnologia" signature), as well as the names and distinctive signs of the in-house products — Vendeon, Vitto, Pulzia and Evometria — may not be used without prior written authorization.

What you may do: access, view and share links to the pages, and quote excerpts with due attribution and a link to the source.

What you may not do: copy, reproduce, modify, translate, distribute or create derivative works from the content for commercial purposes, or remove ownership notices.

Third-party brands and logos occasionally mentioned belong to their respective owners and are referred to descriptively only, without suggesting any affiliation or endorsement.

5. Content you submit

By sending messages through the contact form, you declare that the information is true and that you are authorized to share it. You retain ownership of what you send; we use that content solely to reply and to conduct any resulting commercial relationship, as set out in the Privacy Policy.

6. Liability and limitations

We work to keep the site correct, secure and available. Even so, within the limits permitted by applicable law:

  • the site is provided "as is", with no guarantee that it is entirely free of errors or uninterruptedly available;
  • we are not liable for unavailability arising from third-party failures (hosting, connectivity, providers) or from acts of God and force majeure;
  • we are not liable for decisions you take based solely on the corporate information on the site, without a formal proposal or consultancy;
  • we are not liable for indirect damages, loss of profits or loss of opportunity arising from the use, or the impossibility of use, of the site.

Nothing in these Terms excludes or limits liabilities that cannot be waived by law, including the rights granted to consumers by the Brazilian Consumer Protection Code.

The site contains links to external destinations — social networks, WhatsApp and our products' own websites. Those contents are operated by third parties, with their own policies and terms, over which we have no control.

The presence of a link does not imply endorsement. We recommend reading those third parties' terms and privacy policies. This version of the site embeds no third-party feature in its own pages — see the Cookie Policy.

8. Availability and maintenance

We may, at any time and without prior notice, change, suspend or discontinue — wholly or in part — features of the site, including for maintenance, security updates or technological evolution.

9. Privacy and cookies

The processing of personal data is governed by our Privacy Policy, and the use of cookies by the Cookie Policy. You may review your choices at any time in Cookie Preferences.

10. Changes to these Terms

These Terms may be updated to reflect legal, technical or service changes. The date of the last revision is always at the top of this page. Continued use of the site after a new version is published means agreement with the text in force.

11. Governing law and jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil, in particular the Civil Code, the Consumer Protection Code (where applicable), the Internet Civil Framework (Law 12,965/2014) and the LGPD (Law 13,709/2018).

The courts of the district of Ourinhos, State of São Paulo, Brazil are elected to settle disputes arising from these Terms, waiving any other however privileged — save for the consumer's right to bring an action in the courts of their own domicile, under consumer legislation.
