1. Purpose and acceptance

These Terms govern access to and use of the website vitamunhoztecnologia.com.br, operated by Vita Munhoz Tecnologia, Brazilian company tax ID (CNPJ) 59.414.271/0001-36, with its registered office at Rua Clorivaldo Migliari, 150 - Nova Ourinhos, Ourinhos - SP, CEP 19907-475, Brazil.

By browsing the site, you declare that you have read, understood and agree to these Terms and to our Privacy Policy. If you disagree with any point, please do not use the site.

This site is an institutional and contact channel. It presents our services and lets you talk to us — it is not, in itself, a contracting platform, and it does not process sales or online payments.

2. Services presented

Information about services, technologies, timelines and results published here is informational and non-binding. It does not constitute a commercial proposal or a guarantee of results.

Any engagement depends on a specific proposal and its own contract, with scope, timelines, pricing and conditions negotiated case by case. In the event of a discrepancy between the site and the signed contract, the contract prevails.

3. Permitted use

By using the site, you agree not to:

  • perform acts that compromise the security, integrity or availability of the site, including intrusion attempts, code injection, reverse engineering or unauthorized scanning;
  • use bots, scrapers or automation that overload the infrastructure or circumvent rate limits;
  • submit, through the contact form, unlawful, offensive or defamatory content, spam, or content that infringes third-party rights;
  • reproduce, distribute or commercially exploit the site's content without authorization (see section 4);
  • use the site for any unlawful purpose or any purpose contrary to these Terms.

We may suspend or block access for anyone who breaches these rules, without prejudice to any applicable legal measures.

4. Intellectual property

All content on this site — text, layout, visual identity, logos, trademarks, icons, images, animations, source code and the organization of the information — belongs to Vita Munhoz Tecnologia or to third parties who have licensed it to us, and is protected by the Brazilian Copyright Law (Law No. 9,610/1998), the Industrial Property Law (Law No. 9,279/1996) and the Software Law (Law No. 9,609/1998).

The Vita Munhoz Tecnologia brand (and the "VM Tecnologia" signature), as well as its distinctive signs, may not be used without prior written authorization.

What you may do: access, view and share links to the pages, and quote excerpts with proper attribution and a link to the source.

What you may not do: copy, reproduce, modify, translate, distribute or create derivative works from the content for commercial purposes, or remove ownership notices.

Third-party trademarks and logos mentioned here (for example, technologies we use) belong to their respective owners and are mentioned in a purely descriptive way, without suggesting any affiliation or endorsement.

5. Content you submit

When you send messages through the contact form, you declare that the information is true and that you are authorized to share it. You retain ownership of what you send; we use that content exclusively to reply to you and to conduct any resulting business relationship, as described in our Privacy Policy.

6. Responsibilities and limitations

We work to keep the site accurate, secure and available. Even so, within the limits allowed by applicable law:

  • the site is provided "as is", with no warranty that it is entirely free of errors or that it will be available without interruption;
  • we are not liable for unavailability caused by failures in third-party services (hosting, connectivity, providers) or by acts of God and force majeure;
  • we are not liable for decisions you make based solely on the institutional information on the site, without a formal proposal or consultation;
  • we are not liable for indirect damages, loss of profits or loss of opportunity arising from the use of, or the inability to use, the site.

Nothing in these Terms excludes or limits liability that cannot be waived by law, including the rights granted to consumers by the Brazilian Consumer Protection Code (CDC, Código de Defesa do Consumidor).

The site may contain links to external sites (social networks, WhatsApp, third-party platforms) and embedded features, such as the Google Maps map on the Contact page. That content is operated by third parties, under their own policies and terms, over which we have no control.

The presence of a link does not imply endorsement. We recommend reading those third parties' terms and privacy policies. Embedded features that may set cookies are loaded only with your consent — see the Cookie Policy.

8. Availability and maintenance

We may, at any time and without prior notice, change, suspend or discontinue — fully or partially — features of the site, including for maintenance, security updates or technological evolution.

10. Changes to these Terms

These Terms may be updated to reflect legal, technical or service changes. The date of the last revision is always at the top of this page. Continued use of the site after a new version is published means you agree to the text in force.

11. Governing law and jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil, in particular the Civil Code, the Consumer Protection Code (CDC, where applicable), the Brazilian Internet Bill of Rights (Marco Civil da Internet, Law No. 12,965/2014) and the LGPD (Brazil's General Data Protection Law, Law No. 13,709/2018).

The courts of the judicial district of Ourinhos, State of São Paulo, Brazil, are elected to settle disputes arising from these Terms, waiving any other, however privileged — except for the consumer's right to file suit in the courts of their own domicile, under Brazilian consumer legislation.
